Occupational Safety Specialist Employment Requirement

The purpose of occupational safety is to create safe working conditions to preserve employees’ working capacity and physical integrity. Essentially, the goal of occupational safety is to prevent and avoid health damage and accidents, which can be greatly aided by establishing safe working conditions and understanding the main occupational safety regulations.

Another objective is that the development of occupational safety and the improvement of working conditions contribute to increasing productivity, competitiveness, and the society’s sustainability, as well as maintaining a high-quality workforce. By using well-maintained work equipment, professional knowledge, and attention, workplaces can be made safe, since workplace accidents and illnesses are not inevitable!

According to Decree 5/1993 (XII. 26.) of the Ministry of Labour, every employer is required to employ an occupational safety specialist.

Fire Protection Specialist Employment Requirement

Fire protection refers to the set of measures taken against fire, including fire prevention, firefighting, fire investigation, and ensuring the conditions for these activities.

Businesses are required to define and communicate fire safety rules, maintain fire protection equipment and systems in working order, and ensure their usability. In high-risk industrial or storage units, or where restricted-mobility persons are present (e.g., educational or care institutions), fire safety must be ensured by employing a certified fire protection professional or through a specialized service.

Private individuals, legal entities, and organizations employing more than 50 workers, operating facilities with a capacity of over 50 persons, or running commercial accommodations exceeding 10 guests must prepare a fire safety regulation.

Other businesses must make available the general fire safety regulations issued by the Ministry of Disaster Management to all employees and family members participating in work activities.

According to Decree 101/2023 (XII. 29.) of the Ministry of the Interior, a Fire Alarm Plan must be attached as an annex to the Fire Safety Regulation in cases such as:

  • Facilities accommodating or educating persons with limited mobility;
  • Educational institutions with a maximum capacity exceeding 50 persons;
  • Buildings or spaces for mass gatherings with over 300 people simultaneously present;
  • Commercial accommodations with over 20 guest places;
  • Facilities storing or processing more than 1000 kg or liters of highly flammable or explosive materials.

FIRE PROTECTION TASKS:

  • Preparing and regularly updating fire safety regulations in compliance with legal changes;
  • Preparing fire alarm plans;
  • Developing and conducting fire safety training;
  • Monitoring compliance with fire safety rules and performing inspections as needed;
  • Conducting fire safety audits and helping eliminate deficiencies or irregularities;
  • Representing clients during official inspections;
  • Preparing evacuation plans;
  • Performing evacuation calculations (mandatory for spaces with more than 50 people);
  • Performing risk classification;
  • Organizing and recording fire drills.

Fire Protection Specialist Employment

According to Decree 9/2015 (III. 25.) of the Ministry of the Interior, businesses must employ a person with at least intermediate-level fire protection qualification for a minimum of 8 hours per month if they:

  • Manufacture, process, or store explosive materials exceeding 1000 kg/l but under 5000 kg/l;
  • Store flammable materials in total storage areas between 1000 m² and 10,000 m²;
  • Operate or rent a building with public spaces accommodating up to 500 people;
  • Operate facilities with a total capacity between 500 and 2000 persons;
  • House or educate persons with limited mobility (more than 20 but fewer than 100 persons).

They must employ or contract a person with advanced-level fire protection qualification if they:

  • Operate a full-time on-site fire department;
  • Process or store explosive materials exceeding 5000 kg/l (excluding gas stations);
  • Store flammable materials in total areas exceeding 10,000 m²;
  • Operate or rent buildings with spaces for over 500 people;
  • Operate facilities with a total capacity exceeding 2000 people;
  • Accommodate more than 100 persons with limited mobility.

Maintaining Fire Extinguishers

The National Fire Protection Regulation (Decree 54/2014, XII. 5.) of the Ministry of the Interior states:

Fire extinguishers must be kept ready for use

a) on each floor of independent functional units;

b) wherever specifically required by law, and

c) in all other cases defined by legislation.

Unless otherwise specified, fire extinguishers are not required in private homes or vacation properties, except for rooms serving other purposes within residential buildings.

The fire authority may prescribe additional extinguishers, devices, or materials as necessary.

Fire extinguishers must be placed in a visible, easily accessible location, ready for immediate use in case of fire, and maintained in an operational condition at all times.

Fire extinguishers are also mandatory in vehicles over 3.5 tons, agricultural tractors, machinery, and watercraft, as required by specific laws.

Having a fire extinguisher is not mandatory in private homes, holiday houses, or cars — but when an emergency occurs, what matters is not the regulation, but whether you can act immediately.
